Section 11-89-10 - Waivers(a) Waivers may be granted to a facility, for a specified period of time at the discretion of the department. A waiver may be renewed at the discretion of the department.(b) Waivers of structural requirements shall not be granted unless: (1) All residents are fully ambulatory and capable of self-preservation in emergency situations;(2) The waiver will not create a hazard to health or safety; and(3) Structural changes required would place an undue financial burden upon the licensee.(c) All waivers of the department shall be set forth in writing and shall not be transferred from one licensee to another or from one location to another.[Eff FEB 03 1992] (Auth: HRS §§ 321-9, 321-11, 321-15.9) (Imp: HRS § 321-15.9)
