Section 11-60.1-15 - Reporting of equipment shutdown(a) In the case of shutdown of air pollution control equipment for necessary scheduled maintenance, the intent to shut down such equipment shall be reported to the director at least twenty-four hours prior to the planned shutdown. The prior notice shall include: (1) Identification of the specific equipment to be taken out of service as well as its location and permit number;(2) The expected length of time that the air pollution control equipment will be out of service;(3) The nature and quantity of emissions of air pollutants likely to be emitted during the shutdown period;(4) Measures such as the use of off-shift labor and equipment that will be taken to minimize the length of the shutdown period; and(5) The reasons why it would be impossible or impractical to shut down the source operation during the maintenance period.(b) The submittal of the notice shall not be a defense to an enforcement action.Haw.
