Section 11-46-5 - Exemptions This chapter shall not apply to the following:
(1) Any authorized emergency vehicle or vehicles responding to an emergency call or acting in an emergency;(2) The sounding of any emergency signaling device, including but not limited to civil defense warning systems, burglar and fire alarms, sirens, whistles, or similar signaling devices;(3) Activities related to the emergency maintenance and repair of state and county highways, parks, and public utilities including but not limited to water, sewer, electric, gas, and telephone systems, provided the noise is confined to only the equipment in use;(4) Operation of emergency generators, when installed and used as required and necessary for the protection of public health and safety, provided the best available control technology is implemented;(5) Backup alarm devices on any vehicle, where such device is required by federal or state occupational safety and health regulations;(6) Construction and remedial activities related to the emergency repair of damages caused by natural disasters, including but not limited to tsunamis and hurricanes; and(7) Any school activity which is approved by school authorities; provided that this exemption shall limit these activities to the hours of 7:00 a.m. to 10:00 p.m.[Eff SEP 23 1996] (Auth: HRS §§ 342F-3, 342F-31) (Imp: HRS §§ 342F-3, 342F-30, 342F-31)
