Section 11-280.1-323 - Permit required(a) No person shall install or operate an UST or tank system without first obtaining a permit from the director.(b) The director shall approve an application for a permit only if the applicant has submitted sufficient information to the satisfaction of the director that the technical, financial, and other requirements of this chapter are or can be met and the installation and operation of the UST or tank system will be done in a manner that is protective of human health and the environment.(c) A permit shall be issued only in accordance with chapter 342L, Hawaii Revised Statutes, and this chapter, and it shall be the duty of the permittee to ensure compliance with the law in the installation and operation of the UST or tank system.(d) Issuance of a permit shall not relieve any person of the responsibility to comply fully with all applicable laws.
