Section 11-261.1-15 - Amendments to the incorporation of 40 C.F.R. part 261, subpart M(a) The incorporation by reference of 4 0 C.F.R. section 261.400 is amended as follows: (1) In 40 C.F.R. section 261.400(a), delete ", or an intermediate or reclamation facility operating under a verified recycler variance under § 260.31(d),".(2) In 40 C.F.R. section 261.400(b), delete ", or an intermediate or reclamation facility operating under a verified recycler variance under § 260.31(d)".(b) The incorporation by reference of 4 0 C.F.R. section 261.410 is amended as follows: (1) In 40 C.F.R. section 261.410(e), delete "or intermediate or reclamation facility operating under a verified recycler variance under § 260.31(d)".(2) In 40 C.F.R. section 261.410(f)(1) and (2), delete "or an intermediate or reclamation facility operating under a verified recycler variance under § 260.31(d)".(c) The incorporation by reference of 4 0 C.F.R. section 261.411 is amended as follows: (1) In the introductory paragraph of 4 0 C.F.R. section 261.411, delete "or an intermediate or reclamation facility operating under a verified recycler variance under § 260.31(d)".(2) In 40 C.F.R. section 261.411(b), delete "or intermediate or reclamation facility operating under a verified recycler variance under§ 260.31(d)".(3) In 40 C.F.R. section 261.411(c), delete "or an intermediate or reclamation facility operating under a verified recycler variance under§ 260.31(d)".(4) In 40 C.F.R. section 261.411(d)(3), delete both instances of "or an intermediate or reclamation facility operating under a verified recycler variance under§ 260.31(d)" and insert "the government official designated as the on-scene coordinator from the Hawaii department of health's Hazard Evaluation and Emergency Response Office via the State Hospital at (808) 247-2191 after business hours or directly at (808) 586-4249 during business hours and" before "the National Response Center".
