Section 11-261-20 - General(a) A solid waste, as defined in section 11-261-2, which is not excluded from regulation as a hazardous waste under subsection 11-261-4(b), is a hazardous waste if it exhibits any of the characteristics identified in this subchapter. [Comment: Section 11-262-11 sets forth the generator's responsibility to determine whether his waste exhibits one or more of the characteristics identified in this subchapter.]
(b) A hazardous waste which is identified by a characteristic in this subchapter is assigned every EPA Hazardous Waste Number that is applicable as set forth in this subchapter. This number must be used in complying with the notification requirements of HRS section 342J-6.5 and all applicable recordkeeping and reporting requirements under chapters 11-262 through 11-265, 11-268, and 11-270.(c) For purposes of this subchapter, the director will consider a sample obtained using any of the applicable sampling methods specified in Appendix I to be a representative sample within the meaning of chapter 11-260.[Eff 6/18/94; comp] (Auth: HRS §§ 342J-4, 342J-31, 342J-35) (Imp: 40 C.F.R. §261.20 )
