If the department determines that an existing provider applying for re-certification fails to comply with the certification requirements, it may, within thirty days after the conclusion of the on-site survey, provide a written statement of non-compliance. The statement of non compliance shall describe the areas of non-compliance, suggest action needed to bring the applicant's operation into compliance with the requirements of this chapter, and set forth a timetable for the applicant to submit a written plan of correction.
