(1) In any hearing conducted under the Act and these Rules, the Hearing Officer shall make an independent determination on the basis of the competent evidence presented at the hearing.(2) Unless otherwise provided by federal or state statute or rule, the standard of proof on all issues in a hearing shall be a preponderance of the evidence.Ga.
