Rule 180-10-.01 - Corporate Practice: Professional Engineering(1) As used in O.C.G.A. § 43-15-23(c), the phrase "responsible charge" means the independent control, direction and supervision, by the use of initiative, skill and independent judgment of the practice of professional engineering as defined in O.C.G.A. § 43-15-2(11).(2) In order to be considered eligible for a certificate of authorization, any individual who is in responsible charge of the practice of professional engineering for the firm, corporation, professional corporation, partnership or association or other entity shall be a full-time employee of the firm, corporation, professional corporation, partnership, association or other entity, regularly engaged in the practice of professional engineering. Such individual shall not be: (a) available to perform engineering services only on a part-time, independent contractor basis at the call of such firm, corporation, partnership, association or other business entity; or(b) available on an if-and-when needed consulting basis; or,(c) not actively practicing professional engineering with such firm, corporation, partnership, association or other business entity.(3) The practice of professional engineering for any firm, corporation, partnership, association or other business entity shall not be considered to be under the direction of a professional engineer unless such professional engineer bears a continuing bonafide relation thereto and has such authority from the governing body of such business entity as would result in its being legally liable for all such professional engineer's professional acts and judgments.Ga.
