Rule 111-8-90-.09 - Enforcement(1) The administration and enforcement of these rules shall be as prescribed in Chapter 13 of Title 31 of the Official Code of Georgia Annotated, and Chapter 13 of Title 50 of the Official Code of Georgia Annotated. The Department's action revoking or denying a registration applied for under this Chapter or the imposition of civil penalties imposed pursuant to this Chapter shall be preceded by notice and opportunity for a hearing and shall constitute a contested case within the meaning of Chapter 13 of Title 50 of the Official Code of Georgia Annotated.(2) The Department may, without regard to the availability of other remedies, including administrative remedies, seek an injunction against the continued operation of an unregistered radiation machine or the continued operation of a radiation machine in violation of this Chapter or of any regulation of the Department.Ga.
