Rule 111-8-4-.23 - Enforcement

An ambulatory surgical treatment center which fails to comply with these rules and regulations shall be subject to revocation of its permit or provisional permit and/or other sanctions provided by law. The enforcement and administration of these rules and regulations shall be as prescribed in O.C.G.A. §§ 31-5-8, 31-5-9 and 31-2-8which includes provision for:

(a) the misdemeanor penalty for violation of rules and regulations promulgated under this Title;

(b) injunctive relief under appropriate circumstances; and

(c) the due process requirements of notice, hearing and appeals.
