Section 64B13-15.005 - Designation of Administrative Violations; Major; Minor
(1) Violations of the following statutory and rule provisions are considered to be Minor Administrative Violations:
(a) Section 456.062, F.S., entitled "Advertisement by Health Care Provider of Free or Discounted Services; Required Statement."
(b) Section 456.057, F.S., entitled "Ownership and control of patient records; report or copies of records to be furnished."
(c) Section 463.011, F.S., entitled "Exhibition of License."
(d) Subsection (1), paragraphs (2)(a) and (b) of section 463.012, F.S., entitled "Prescriptions; Filing; Release; Duplication."
(e) Subsection 463.0135(11), F.S., entitled "Standards of Practice," if the violation is of a technical nature not related to patient care.
(f) Paragraphs (1)(d) and (e) of section 463.014, F.S., entitled "Certain Acts Prohibited."
(g) For the first violation of subsection 463.0141, F.S., entitled "Reports of adverse incidents in the practice of optometry."
(h) Rule 64B 13-3.002, F.A.C., entitled "Responsibility to Patient."
(i) Rule 64B 13-3.005, F.A.C., entitled "Entrance Sign."
(j) Rule 64B 13-3.006, F.A.C., entitled "Licenses and Signs in Office."
(k) Rule 64B 13-3.012, F.A.C., entitled "Prescriptions" if the violation consists of failing to release a prescription or technical omissions or errors on the prescription not related to patient care.
(l) Section 456.072(1)(nn), F.S., violating any provision of section 790.338, F.S.
(m) Subsections (1), (2) and (5) of section 465.0276, F.S., entitled "Dispensing Practitioner," if the violation is of a technical nature not related to patient care.
(2) Violations of the following statutory and rule provisions are considered to be Major Administrative Violations:
(a) Sections 456.072(1)(a), (b), (c), (e), (f), (g), (h), (i), (k), (m), (q), (r), (s), (w), (x), (cc), (gg), (ii), (jj), (kk), (ll), (pp), F.S., entitled "Grounds for Discipline; Penalties; Enforcement."
(b) Section 463.0135(7) and (8), F.S., entitled "Standards of Practice."
(c) Section 463.0135(11), F.S., entitled "Standards of Practice," if the violation is substantially likely to affect patient care.
(d) Section 463.014(1)(a) and (b), F.S., entitled "Certain Acts Prohibited."
(e) For a second or subsequent violation of Section 463.014 1, F.S., entitled "Reports of adverse incidents in the practice of optometry.
(f) Sections 463.015(1)(a), (b), (c) and (2)(a), (c) and (d), F.S., entitled "Violations and Penalties."
(g) Sections 463.016(1)(a), (b), (c), (d), (e), (f), (g), (h), (i), (k), (l), (m), (n), (o), (q), (r) and (s), F.S., entitled "Grounds for Disciplinary Action; Action by the Board."
(h) Subsection (1), (2) and (5) of Section 465.0276, F.S., entitled "Dispensing Practitioner," if the violation is substantially likely to affect patient care.
(i) Rule 64B 13-3.001, F.A.C., entitled "Confidential Information; Disclosure."
(j) Rule 64B 13-3.003, F.A.C., entitled "Patient Records; Transfer or Death of Licensed Practitioner."
(k) Paragraphs (2)(a), (b), (c), (d), (e), (f) and subsections (4), (5) and (6) of Rule 64B 13-3.009, F.A.C., entitled "False, Fraudulent, Deceptive and Misleading Advertising Prohibited; Policy; Definitions; Affirmative Disclosure."
(l) Rule 64B 13-3.012, F.A.C., entitled "Prescriptions" if the violation is substantially likely to affect patient care.
(m) Subsection (3) of Rule 64B 13-11.001, F.A.C., entitled "Inactive Status."
(n) Rule 64B 13-5.001, F.A.C., entitled "Hours Requirement."
(o) Section 456.0301(1)(a), F.S., failure by a certified optometrist registered with the United States Drug Enforcement Administration (DEA) to complete the required two (2) hour course on prescribing controlled substances prior to January 31, 2019.
(p) Section 465.0276(2)(d)1., F.S., dispensing a controlled substance to a person not known to the dispenser without requiring valid photographic identification or other verification of identity.
(q) Section 893.055(3), F.S., failure to report information regarding dispensed controlled substances to the Prescription Drug Monitoring Program Controlled Substance Dispensing Information Electronic System.
(r) Section 893.0551(6), F.S., failure to maintain confidentiality of information obtained from the Prescription Drug Monitoring Program Controlled Substance Dispensing Information Electronic System.
(s) Section 893.055(8), F.S., second or subsequent failure to consult the Prescription Drug Monitoring Program Controlled Substance Dispensing Information Electronic System prior to prescribing or dispensing a schedule IV or schedule V opioid controlled substance.
(3) For any offense which is not specified above or in subsection (1) or (2) of Rule 64B 13-15.006, F.A.C., the Board will apply the guideline penalty based on the offense listed which is most comparable to the offense charged.
