Section 61G7-12.001 - Contractual Requirements

In order to meet the requirements of Section 468.525(4), F.S., the employee leasing company's contractual arrangement with its client must provide for the right of both the employee leasing company and its assigns to conduct an annual onsite physical examination of the client who is or was subject to an applicable employee leasing contractual relationship. The purpose of this examination is to aid in the determination of proper workers' compensation classifications of leased employees and to aid in the determination of payroll amounts paid to such leased employees. Such examination shall allow for both the employee leasing company and its assigns to conduct audits of the client for the purposes set forth above to the extent set forth in Section 440.381, F.S., and the rules promulgated thereto by the Department of Financial Services, Division of Workers' Compensation.
