Section 33-404.2098 - Continued Placement in Mental Health Treatment Facilities(1) An inmate may be retained in a corrections mental health treatment facility if he or she has a mental disorder and continues to be in need of care and treatment as defined in Section 945.42(6), F.S.(2) In accordance with Section 945.45, F.S., the warden of the institution where the corrections mental health treatment facility is located shall file a petition with the Division of Administrative Hearings for an order authorizing continued placement of an inmate in the facility prior to the expiration of the period during which the facility is authorized to retain the inmate.Fla.
