Rule 7-1608 - SOLE SOURCE PROCUREMENTS
1608.1

A sole source procurement may be awarded through non-competitive negotiations when the Chief Contracting Officer determines, in writing, that there is only one (1) qualified source for the required good or service.

1608.2

The Chief Contracting Officer's written determination supporting a sole source procurement shall include:

(a) A description of the goods or services sought; and
(b) An explanation of why the goods or services are only available from one (1) qualified source.
1608.3

The Contracting Officer shall publish a notice of intent to award a sole source contract on the Board's website for at least ten (10) business days prior to contract award. A notice of intent to award a sole source contract shall include:

(a) The proposed determination and findings supporting the sole source procurement;
(b) A clear description of the goods or services to be procured;
(c) The intended sole source contractor.
1608.4

A sole source procurement shall not be justified on the basis of:

(a) Lack of adequate procurement planning;
(b) Administrative delays, lack of sufficient procurement personnel, or improper handling of procurement requests or competitive procedures; or
(c) Pending expiration of budget authority.
1608.5

Sole source awards, regardless of dollar value, shall be published on the Board's website within seven (7) business days of award and shall include:

(a) The determination and findings supporting the sole source procurement;
(b) The name of the vendor awarded contract; and
(c) The total value of the awarded contract, including any options.
1608.6

All information published under this section shall be removed from the Board's website upon the expiration or termination of the contract, or after five (5) years of award, whichever is longer.
