Exempt time off is a benefit to an overtime exempt employee in the form of time off for extraordinary hours worked. Given the nature of public business, an employee may be required by the Attorney General to work extraordinary hours from time to time. For that reason, the Attorney General, at his discretion, may grant exempt time off, which shall be accrued in accordance with chapter 11 of subtitle B of title 6.
An overtime exempt employee must request the use of exempt time off in writing and the use of approved exempt time must be authorized in advance by the employee's supervisor.
Exempt time off may be used in the same manner as annual or sick leave.
