A complaint filed with OHR under the provisions of the Act may be voluntarily withdrawn at the request of the complainant at any time prior to the completion of the Office's investigation and findings, as specified in section 305 of the Act (D.C. Official Code § 2-1403.05) .
The circumstances of a voluntary withdrawal may be fully investigated by OHR.
A complainant may request that the Director reopen a complaint that the complainant previously withdrew voluntarily if the complainant submits a written request within thirty (30) days after the voluntary withdrawal. The request shall state specifically the reasons why the complaint should be reopened.
The Director, after receiving a request to reopen a complaint, may reopen the complaint for good reasons or in the interest of justice, if no determination has previously been made on the merits of the complaint. The decision whether to reopen the complaint shall be within the discretion of the Director.
