Rule 3-422 - RULEMAKING HEARINGS
422.1

The rules of procedure set forth in this section shall apply to rulemaking proceedings.

422.2

Any person may appear at a hearing in a rulemaking proceeding, and may present, within the time limits determined by the Board, evidence, testimony, or argument that is relevant and not unduly repetitious.

422.3

No person shall have the standing of a party in a rulemaking proceeding.

422.4

The order of procedure at the hearing shall be as follows:

(a) Call to order and opening statement by the Chairperson;
(b) Introductory statement by the Executive Director, General Counsel, or other staff designated by the Board;
(c) Consideration of pending motions and procedural matters;
(d) Applicant's or petitioner's case;
(e) Persons in support of the application or petition; and
(f) Persons in opposition to the application or petition.
