Rule 27-3230 - CONTRACT DEBT DETERMINATION AND COLLECTION
3230.1

In addition to the provisions of chapter 38 of this title, the provisions of §§ 3230 through 3237 shall apply to all debts to the District arising under, or relating to, a procurement contract or subcontract, except as otherwise provided in § 803 of the Act, D.C. Official Code § 2-308.03 (2001)..

3230.2

In determining the amount of any contract debt, the contracting officer and the Director shall fairly consider both the District's claim and any contract claims by the contractor against the District pursuant to chapter 38 of this title.

3230.3

The contracting officer, or other official designated to administer the collection of contract debts and applicable interest, shall use all proper means available for collecting debts as rapidly as possible.

3230.4

Except in cases in which an agreement has been entered into for deferment of collections, or when bankruptcy proceedings against the contractor have been initiated, the contractor shall liquidate the debt by either of the following methods:

(a) Cash payment in a lump sum on demand; or
(b) Credit against existing payments due to the contractor.
