Rule 27-2401 - SELECTING CONTRACT TYPES
2401.1

The contracting officer shall identify the type of contract, or combination of types of contracts, to be used prior to solicitation. The solicitation shall inform bidders of the type of contract, or combination of types of contracts, to be used.

2401.2

In selecting the type of contract to be used, the contracting officer shall consider the following factors:

(a) The type and complexity of the good or service being procured;
(b) Price competition;
(c) The difficulty of estimating performance costs;
(d) The administrative costs to both the contractor and the District;
(e) The urgency of the requirement;
(f) The length of contract performance;
(g) Any concurrent contracts;
(h) The risk involved;
(i) The stability of material or commodity market prices or wage levels;
(j) The contractor's technical capability and financial responsibility; and
(k) Any other factor the consideration of which the contracting officer believes will better inform the choice of contract type.
