Rule 19-4322 - DELIVERY AND PERFORMANCE
4322.1

Time of delivery and performance is an essential solicitation and contract element and shall be clearly stated in each solicitation and contract award.

4322.2

The CCO shall ensure that a delivery or performance schedule is realistic and meets the requirements of the procurement.

4322.3

Time of delivery or performance shall be considered in the evaluation of bids and proposals and shall be included in all solicitations.

4322.4

When establishing delivery or performance schedules, the CCO shall consider the following factors:

(a) Urgency of need;
(b) Market conditions;
(c) Transportation time;
(d) Production time; and
(e) Transition time from the incumbent contractor to the successor contractor.
