All powers of the Commission shall be vested in and exercised by or under the authority of, and the affairs of the Commission managed under the direction of, the Board of Directors.
All members of the Board of Directors shall be residents of the District. Members of the Board of Directors shall include prominent business, civic, and sports leaders. Representation on the Board of Directors shall include, but not be limited to, individuals with experience and understanding of the political, financial, and organizational structure of sports.
The DC Sports Commission Board of Directors (the "Board") shall consist of 11 members, 8 of whom shall be nominated by the Mayor of the District of Columbia subject to the advice and consent of the Council of the District of Columbia. The Commanding General of the District of Columbia National Guard, the Chief Financial Officer of the District of Columbia and the Director of the District of Columbia Department of Parks and Recreation shall serve as an ex officio members of the Board of Directors with full privileges of Board membership.
Each member, before assuming the duties of Board membership, shall take and Subscribe to an oath to perform the duties of office faithfully, impartially, and justly to the best of the member's ability.
Members, other than the ex officio members shall serve a 4-year term of office, except that of the members first appointed, 1 member shall be appointed to a 1-year term of office, 2 members shall be appointed to a 2-year term of office, 2 members shall be appointed to a 3-year term of office, and 3 members shall be appointed to a 4-year term of office from August 18, 1995 until December 31 of the applicable year.
Vacancies on the Board shall be filled in the same manner that the original appointment was made.
A member whose term has expired may continue to serve until a new member is appointed. Members shall be eligible for reappointment.
A member may resign at any time by delivering written notice to the Chairperson. Once delivered, such notice of resignation is irrevocable and, unless otherwise specified, shall be effective upon receipt by the Chairperson.
Upon written notice by a majority of the Board, a member may be removed for failure to establish or maintain District residency, misconduct, or neglect of duty. Notwithstanding, if a member is indicted for the commission of a felony, the member shall be automatically suspended from serving on the Board. Upon a final determination of guilt or innocence, the term of such member shall, respectively, be automatically terminated or reinstated.
