Rule 17-2421 - REFUSAL TO PERFORM NOTARIAL ACTS
2421.1

A notary public may refuse to perform a notarial act unless refusal is prohibited by a law other than this chapter.

2421.2

A notary public, other than a notary public acting pursuant to a commission from the federal government, may refuse to perform a notarial act if the notary is not satisfied that:

(a) The individual executing the record is competent or has the capacity to execute the record; or
(b) The individual's signature is knowingly and voluntarily made.
