Rule 16-3801 - HISTORIC PRESERVATION INFRACTIONS

3801.2

Violations of any of the following provisions shall be a Class 2 infraction:

(a) Sections 5, 6 and 8 of the Historic Landmark and Historic District Protection Act of 1978, effective, March 3, 1979 (D.C. Law 2-144; D.C. Official Code §§ 6-1104, 6-1105, 6-1107) (failure to comply with the permit review procedures for demolition, alteration, or construction of buildings or structures in historic districts or which are themselves historic landmarks);
(b) 10A DCMR § 410 and § 411 (failure to comply with terms or conditions of approval by the Historic Preservation Office, Historic Preservation Review Board, or Mayor's Agent); and
(c) Section 5 b (a) of the Historic Landmark and Historic District Protection Act of 1978, effective April 27, 2001 (D.C. Law 13-281; D.C Official Code § 6-1104.02(a)) (failure to protect a historic building or structure from demolition by neglect).

Violation of the following provision shall be a Class 3 infraction:

(a) Section 5 a (a) of the Historic Landmark and Historic District Protection Act of 1978 (D.C Official Code § 6-1104.01(a)) (failure to protect a historic building or structure against decay and deterioration).
