705.1 In the NMU-7B/ES zone, the maximum permitted building height, not including a penthouse or rooftop structure, shall be as follows:
(a) Forty-five feet (45 ft.); or(b) Fifty-five feet (55 ft.) for Inclusionary Developments provided that a one-to-one (1:1) building setback shall be provided for any portion of a building or structure facing Eighth Street, S.E., that exceeds forty-five feet (45 ft.).D.C.
