Rule 10-B4300 - GENERAL PROVISIONS
4300.1

This chapter sets forth rules governing the operation of the District of Columbia Housing Finance for Elderly, Dependent, and Disabled (HoFEDD) Program, administered by the District of Columbia Department of Housing and Community Development (DHCD).

4300.2

The purpose of the HoFEDD Program shall be to provide financing (loans) to private for-profit and not-for-profit applicants to facilitate the development of housing, including community based residential facilities, for special needs individuals and families, as defined in § 4399 including, but not limited to, the following:

(a) Elderly households;
(b) Handicapped or disabled households (including physical, mental and emotional disabilities);
(c) Homeless individuals and families;
(d) Foster care clients;
(e) Mentally retarded children and adults;
(f) Adjudicated and pre-adjudicated youth;
(g) Adult ex-offenders living under court-ordered supervision; and
(f) Individuals undergoing treatment for substance abuse.
4300.3

HoFEDD financing may not be used by an applicant for any facility having a medical component, providing full time professional nursing care or requiring a certificate of need from the State Health Planning and Development Agency of the D.C. Department of Human Services, excepting facilities housing eight (8) or fewer persons which provide intermediate care for the mentally retarded.

4300.4

The HoFEDD Program is established under the authority of the District of Columbia Community Development Act of 1975, D.C. Law 1-39 (D.C. Code 5-901 et seq. (1981)).

4300.5

The Director, for good cause shown in writing, may waive any provision of this chapter, consistent with applicable law.
