Rule 10-B3212 - UNSOLICITED OFFERS FOR DEVELOPMENT
3212.1

All unsolicited offers for Department sites sent or referred to the Department shall be forwarded to the Director of the Department for appropriate action.

3212.2

The Director or an assigned member of the Department shall immediately acknowledge the offer for development and advise the offeror that the Director will do the following:

(a) Authorize negotiations;
(b) Deny the request for negotiations; or
(c) Require additional information before a final decision can be made.
3212.3

When the Director decides to authorize under § 3212.2(a), the authorization shall be based upon a finding of the existence of one (1) or more of the conditions set forth in § 3202.3.

3212.4

The Department shall notify the offeror in writing that the request for negotiation is to be considered by the Director.

3212.5

The Director shall either reject or conditionally accept the offer of the developer and shall stipulate a time by which negotiations are to be completed. The Director may also require periodic reports on the status of the negotiations.

3212.6

If the offer is rejected, the Department shall forward a copy of the Director's decision to the offeror.

3212.7

If the offer is conditionally accepted, the Director shall instruct the staff to submit to proposal to the Council for a ninety-day (90) review and approval period and to simultaneously begin negotiations with the offeror.
