Section 7102-31.0 - Requiring other information
31.1 The Department may require the owner or operator of any well that has been authorized by rule under this subpart to submit information deemed necessary by the Department to determine whether a well may be contaminating, or poses a threat of contamination to, an underground source of drinking water in violation of Section 24.0.
31.2 The Department may require, among other things:
31.2.1 Performance of groundwater monitoring and the periodic submission of reports of such monitoring;
31.2.2 An analysis of injected fluids, including periodic submission of such analyses; and
31.2.3 A description of the geologic strata through and into which injection is taking place.
31.2.4 A determination of the location of private supply wells and public supply wells within 1/4 mile radius from the injection area.
31.3 Any request for information under this Section shall be made by the Department in writing, and may include a brief statement of the reasons for requiring the information. An owner or operator shall submit the information within the time period(s) provided in the notice.
31.4 An owner or operator of an injection well that has been authorized by rule under this subpart is prohibited from injecting into such well if the owner or operator fails to comply with a request for information within the time period(s) specified by the Department pursuant to subsection 31.3. An owner or operator of a well prohibited from injection under this Section shall not resume injection except under a permit issued pursuant to Section 29.0 or 32.0.
31.5 The applicant is required to submit any requested information, within the time requested by the GWDS or the application may be returned as incomplete.
