Section 7102-21.0 - Confidentiality of information
21.1 Any information submitted to the Department pursuant to these regulations may be claimed as confidential by the submitter. Any such claim must be asserted at the time of submission, in accordance with the Department's Freedom of Information Act Regulations and the Freedom of Information Act, 29 Del. C. Ch. 100. If no claim of confidentiality is made at the time of submission, the Department may make the information available to the public without further notice. If a claim is asserted, the information will be treated in accordance with Department procedures.
21.2 The following information shall not be deemed confidential:
21.2.1 The name and address of any permit applicant or permittee;
21.2.2 Information relating to the existence, absence, or level of contaminants in drinking water; and
21.2.3 Any monitoring data submitted as part of a permit application or submitted as part of a permit requirement.
