Section 1352-D-2.0 - Compliance Dates and Documentation of Compliance

2.1 Required Financial Responsibility Documentation and Dates of Compliance

2.1.1 Owners and Operators of ASTs shall comply with the requirements of PART D by June 1, 2005.

2.1.2 Owners and Operators shall submit the appropriate documentation as referenced in PART D, Sections 5.0 through 15.0 and Forms A through Q once every 12 months to the Department as proof of compliance with the financial responsibility requirements of this Part. Owners and Operators shall maintain a copy of all documentation as referenced in PART D, Sections 5.0 through 15.0 and Forms A-through Q of PART D.

2.1.3 Owners and Operators shall maintain evidence of all current and historical financial responsibility mechanisms used to demonstrate financial responsibility under PART D until released from the requirements under PART D, Section 19.0.

2.1.4 Records documenting compliance with the financial responsibility requirements of this Part shall be made available upon the request of the Department.

2.1.5 Owners and Operators shall submit to the Department documentation of the current mechanism within 30 days of confirmation of a release from the AST.

2.1.6 No AST shall contain a regulated substance without a current and valid financial responsibility mechanism in accordance with the applicable requirements of this regulation.
