Section 1352-D-19.0 - Release from the Requirements of Financial Responsibility

19.1 Requirements for Release from the Requirements of Financial Responsibility

19.1.1 An Owner and Operator is no longer required to maintain financial responsibility under PART D for an AST when:

19.1.1.1 The requirements of PART B, Section 14.0 have been met; and

19.1.1.2 When the financial responsibility mechanism being used is Self-Insurance, guarantee, surety bond, letter of credit, trust fund, local government bond rating test, local government financial test, local government guarantee, or local government fund after corrective action has been completed as required by PART E of this regulation; or

19.1.1.3 When the financial responsibility mechanism being utilized is Insurance, a claim has been submitted to the Insurance provider in accordance with all the requirements set forth by the Insurance provider and the applicable policy requirements.
