Section 1352-D-16.0 - Substitution of Financial Responsibility Mechanisms by Owner or Operator

16.1 Requirements for Substitution of Financial Responsibility Mechanisms

16.1.1 An Owner or Operator may substitute any alternate financial responsibility mechanisms as specified in PART D, provided that at all times the Owner or Operator maintains an effective financial responsibility mechanism or combination of mechanisms that satisfies the requirements of PART D, Section 3.0.

16.1.2 After obtaining alternate financial responsibility as specified in PART D, an Owner or Operator may cancel a financial responsibility mechanism by providing notice as evidenced by verifiable service, to the Provider of Financial Responsibility and shall submit a copy of such notice to the Department within 10 days of the change.

16.1.3 When an Owner or Operator changes from one type of financial responsibility mechanism to another, the Owner or Operator shall submit the required documentation as stipulated in this regulation for the new financial responsibility mechanism to the Department within 10 days of the change.
