Section 1107-2.0 - Restrictions
2.1 No person shall cause or allow particulate emissions from refuse incinerators into the atmosphere in excess of the appropriate mass emission rate indicated in Table 2-1 of this regulation.

2.2 No person shall cause or allow the construction of any new incinerator or the reconstruction of any existing incinerator except for the disposal of:
2.2.1 Human remains by cremation
2.2.2 Remains of animals not regulated by 7 DE Admin. Code 1129
2.2.3 Industrial waste or sludge in specific instances where no other method of disposal is acceptable to the Secretary
2.2.4 Composted refuse or sludge from sewage treatment plants specifically prepared for incineration
2.2.5 Refuse regulated by the U.S. Department of Agriculture
2.3 No person shall cause or allow the operation of an incinerator used for the destruction or disposal of wastes allowed in 2.2 of this regulation unless the combustion temperature in the secondary chamber is greater than 1400 degrees F. An indicating pyrometer or other temperature control device shall be installed in such a manner to accurately determine combustion chamber temperature.
