Section 1148-2.0 - Applicability

2.1 This regulation applies to existing, stationary combustion turbine electric generating units located in Delaware with a base-load nameplate capacity of one MW or greater.

2.2 This regulation is not applicable to existing stationary combustion turbine electric generating units that are subject to 7 DE Admin. Code 1112 "Control of Nitrogen Oxides Emissions," and meet the NO_x emissions limitations identified in Table 3-2 of 7 DE Admin. Code 1112, and are not otherwise exempt from the NO_x emissions limitations of Table 3-2 of 7 DE Admin. Code 1112.

2.3 This regulation is not applicable to existing stationary combustion turbine electric generating units that have undergone New Source Review in accordance with 7 DE Admin. Code 1125 "Requirements for Preconstruction Review," and are covered by a permit which imposes NO_x emissions limitations established to meet Best Available Control Technology or Lowest Achievable Emission Rate technology standards.
