Section 904-16.0 - Effective Date16.1 Effective date. This regulation is effective as of July 1, 2001.16.2 Notice requirement for consumers who are the licensee's customers on the compliance date. By November 1, 2001, a licensee shall provide an initial notice, as required by subsection 2.1 of this regulation, to consumers who are the licensee's customers on July 1, 2001.16.3 Example. A licensee provides an initial notice to consumers who are its customers on November 1, 2001, if, by the licensee has established a system for providing an initial notice to all new customers and has mailed the initial notice to all the licensee's existing customers.16.4 Two-year grandfathering of service agreements. Until July 1, 2002, a contract that a licensee has entered into with a nonaffiliated third party to perform services for the licensee or functions on the licensee's behalf satisfies the provisions of subsection 9.1.1.2 of this regulation, even if the contract does not include a requirement that the third party maintain the confidentiality of nonpublic personal information, as long as the licensee entered into the agreement on or before July 1, 2000.16.5 The amendments to subsections 1.5 and 2.6 of this regulation shall be effective on July 1, 2019.16.6 The exception to the annual notice requirement set forth in subsection 2.2.1.2 of this regulation shall be effective {fill in the date that is 10 days after the publication date of the notice of adoption of that requirement}.18 Del.
