Section 3315-10.0 - Disciplinary Actions10.1 Any person who fails to comply with these regulations shall be fined not less than $100 and not more than $1000, together with costs, unless otherwise provided by law.10.2 Before any disciplinary action is taken: 10.2.1 The Department shall give ten calendar days written notice to the holder of the license, setting forth the reasons for the determination.10.2.2 The disciplinary action shall become final ten calendar days after the mailing of the notice unless the licensee, within such ten calendar day period, shall give written notice of the desire for a hearing. 10.2.2.1 If the licensee gives such notice, the licensee shall be given a hearing before the Secretary of the Department or her/his designee and may present such evidence as may be proper.10.2.2.2 The Secretary of the Department or her/his designee shall make a determination based upon the evidence presented.10.2.2.3 A written copy of the determination and the reasons upon which it is based shall be sent to the licensee.10.2.2.4 The decision shall become final ten calendar days after the mailing of the determination letter unless the licensee, within the ten calendar day period, appeals the decision to the appropriate court of the State.16 Del.
