Section 922-1.0 - Purposes1.1Regulations 922 to 929 (14 DE Admin. Code 922 to 929) implement, complement and supplement the Individuals with Disabilities Education Act, as amended (20 U.S.C. 1400 et seq.), its implementing regulations ( 34 CFR part 300), and 14 Del.C. Ch. 31 (with the exception of Subchapter IV). They are designed and intended to ensure compliance with state and federal laws concerning the education of children with disabilities. To the extent these regulations conflict with the federal regulations implementing Part B of the Individuals with Disabilities Education Act, the federal regulations shall prevail. Further, the purposes of these regulations are:1.1.1 To ensure that all children with disabilities have available to them a free appropriate public education that emphasizes special education and related services designed to meet their unique needs and prepare them for further education, employment, and independent living;1.1.2 To ensure that the rights of children with disabilities and their parents are protected;1.1.3 To assist local educational agencies, educational service agencies, and public agencies to provide for the education of all children with disabilities; and1.1.4 To assess and ensure the effectiveness of efforts to educate children with disabilities.
