Section 19a-9-15 - Agency's authority to investigate, refer and dismiss petitions and requests for declaratory rulings
(a) The agency may initiate and conduct any investigation that the agency deems necessary within the agency's jurisdiction.
(b) If, after receipt or investigation of a petition or request for a declaratory ruling, the agency determines that it lacks jurisdiction or that there is insufficient evidence to establish the alleged violation, it shall dismiss the petition or request. The agency shall notify the petitioner or the person making the request, and any respondent who is the subject of the investigation, in writing, of the dismissal. The agency may, in the exercise of discretion, refer any petition or request to another person, agency, or department within the executive or judicial branch.
