Section 3 CCR 702-4-9-2-11 - Policy Forms and Related Material
A. Form and Annual Certification Submission Requirements
1. Form Filings.
a. All form and annual certification filings shall be filed electronically in a format made available by the Division of Insurance (Division).
b. The appropriate SERFF TOI/Sub-TOI codes shall be applied to the filing when creating the SERFF filing.
c. The Form Schedule tab in SERFF shall be completed for all form filings. This tab shall list all coverages, riders, endorsements, and certificates affected by the filing. Actual forms shall not be attached to the form filing.
d. The "Effective Date Requested" field on the General Information tab in SERFF for a health credit filing or the "Effective Date Requested" field for a property and casualty credit filing shall be completed with a specific prospective date and shall be at least thirty-one (31) days after the submission date of the filing. Using a notation such as "On Approval" is not a valid response.
e. Carriers shall file a fully-executed "Colorado Credit Insurance Policy Certification Form for Annual Reports and Listings of New and/or Revised Policy Forms (FORM "CI")" available in Appendix B of this regulation.

Please note: For form filings, the signature shall use a current date of signature.

2. Annual Report. No later than July 1 of each year, each credit insurer shall file an annual report of coverage forms as specified in Section 11.A.1 above, with the following specific requirements:
a. All annual certification filings shall be filed electronically in a format made available by the Division, unless exempted by rule for an emergency situation as determined by the Commissioner.
b. The appropriate SERFF TOI/Sub-TOI codes shall be applied to the filing when creating the SERFF filing.
c. The SERFF Filing Type shall be "Annual Certification."
d. The SERFF "Effective Date Requested" field for a health annual report or the SERFF "Effective Date Requested" field for a property and casualty annual report, is not required to be completed. Using a notation such as "On Approval" is not a valid response.
e. The Form Schedule tab in SERFF shall be completed for all annual filings. This tab shall list all policies, riders, endorsements, and certificates affected by the filing. Actual forms shall not be attached to the form filing.
f. Carriers shall file a fully-executed "Colorado Credit Insurance Policy Certification Form for Annual Reports and Listings of New and/or Revised Policy Forms (FORM "CI")" available in Appendix B of this regulation.

B. Elements of Certification

The elements of certification as determined by the Commissioner, which shall be included in the Colorado credit insurance certification form are as follows:

1. The name of the insurer, the form number(s) and the type of creditors who will be using the forms (e.g. banks, credit unions, auto dealers);
2. A statement that the officer signing the certification form is knowledgeable about credit insurance;
3. A statement that the officer signing the certification form has carefully reviewed the policy forms, subscription certificates, membership certificates or other evidences of credit insurance coverage identified on the listing of new policy forms or annual report;
4. A statement that the officer signing the certification form has read and understands each applicable law, regulation and bulletin;
5. A statement that the officer signing the certification form is aware of the applicable penalties for certification of a non-complying form;
6. A statement that the officer signing the certification form certifies:

For listings of new policy forms for credit insurance, that to the best of the officer's knowledge, the documents identified on the Listing of New Policy Forms or Annual Report provide all applicable mandated benefits and are in full compliance with all Colorado Insurance laws and regulations.

7. The name and title of the officer signing the certification form and the date the certification form is signed. If the individual signing the certification is other than the president, vice president, assistant vice president, corporate secretary, assistant corporate secretary, CEO, CFO, COO, general counsel, or an actuary that is also a corporate officer, documentation shall be included that shows that this individual has been appointed as an officer of the organization by the Board of Directors. Electronic signatures are not acceptable UNLESS provided through a signature verification provider such as VeriSign.
8. The original signature of the officer. Signature stamps, photocopies or signatures on behalf of the officer are not acceptable. Electronic signatures are not acceptable UNLESS provided through a signature verification provider such as VeriSign.
C. Evidence of Coverage

All credit insurance shall be evidenced by an individual policy, or in the case of group insurance, by a certificate of insurance. It is the responsibility of the insurer that these policies or certificates are provided to the debtor.
