Chapter 7 - SUPPLEMENTAL DISCLOSURES AND RECORD RETENTION FOR CDOT'S PUBLIC PROJECTS THAT ARE NON-FEDERALLY FUNDED
7.01 In the event that there is insufficient Colorado labor to perform the work of the project, and if compliance with Section 8-17-101, et seq. C.R.S., would be Unduly Burdensome, causing the prevention of project completion, CDOT shall post a notice of such justifiable waiver pursuant to Section 8-17-101, C.R.S., on the CDOT website.
7.02 CDOT shall maintain a Contract file for a period of six years for all projects Awarded on a CSBV basis. Those CSBV Bid files shall contain the basis upon which the Award determination was made.
7.03 For all projects not funded in any part with federal moneys, CDOT shall post on the CDOT website a listing of such projects including the rationale used to determine whether advertisement and award will be either by Low Bidder or CSBV standard.
7.04 CDOT shall post on the CDOT website any report received by CDOT from Contractors who either:
(a) Report that they anticipate their Work or any Subcontractor's Work will be performed outside of the United States or Colorado; or
(b) Report that they have learned, after the Award of the Contract, the Work under the Contract will be performed outside of the United States or Colorado.
7.05 CDOT shall summarize reports posted pursuant to Section 7.04 of the rules in an annual report to the Colorado General Assembly by January 1 each year.
