Rule 2 CCR 402-8-8 - VARIANCES8.1 Written Requests- Variances to these rules may be granted by the State Engineer upon written request and a showing by the applicant that the requested variance will comply with the intent of these rules to protect the public safety, health and environment, and ensure that requirements of the senior appropriator's use shall be met, subject to Rule 3.6.8.2 Written Response- The State Engineer shall approve or deny the variance request in writing within 60 days of receipt thereof. The reasons for the decision shall be given and conditions necessary to implement the intent of these rules may be imposed.
