Section 36-20-107(1), C.R.S. (2011), empowers the Executive Director of the Department of Natural Resources ("Director") to promulgate rules necessary to effectuate the purposes of the Weather Modification Act of 1972 (the "Act"). Section 36-20-107(3)(a), C.R.S. requires the Director to ensure that the Rules are up to date and consistent with the Act. The Director may delegate to the Director of the Colorado Water Conservation Board, or another designee, the authority to administer the Act, to issue permits, and to regulate weather modification activities permitted pursuant to the Act pursuant to section 36-20-108(3)(b) C.R.S. (2011).
