Section 8 CCR 1406-1-6.401 - NEGATIVE LICENSING ACTION APPEALSA. In the case of a petition by the Department or an appeal by a licensee or an applicant for a license, for an issue related to license status, the decision of the Administrative Law Judge is an Initial Decision subject to Department review or modification. The Department will review the Initial Decision and issue a Final Agency Decision. The Final Agency Decision is subject to judicial review, pursuant to sections 24-4-106 and 26.5-1-107, C.R.S.B. The licensing appeal process may be initiated by the licensee/applicant, their legal representative, or by the Department.
