Part 1 - STATUTORY AUTHORITY AND APPLICABILITY
1.1 The statutory authority for the promulgation of these regulations is set forth in Sections 25-1.5-103, 25-1.5-114, 25-3-101, and 25-3-119, et seq., C.R.S.
1.2 Applicability
(A) Freestanding Emergency Departments (FSEDs) shall comply with all applicable federal, state, and local laws and regulations, including, but not limited to:
(1)6 CCR 1011-1, Chapter 2.
(2) Radiological services involving the use of machines that produce ionizing radiation or the use of radioactive materials for diagnostic purposes shall be in compliance with 6 CCR 1007-1, Rules and Regulations Pertaining to Radiation Control.
(B) Contracted services shall meet the standards established herein.
(C) An FSED for which operations are directly or indirectly owned or controlled by, in whole or in part, or affiliated with a larger, corporate system may fulfill the following requirements of this Chapter 13 through a central system common to the entire organization, providing that the intent of the requirements of this chapter is met. The specific policies applicable to the FSED, that shall be identified and made accessible to FSED staff, include:
(1) Administrative records, including, but not limited to, personnel functions;
(2) Policies and procedures, including infection prevention and control and antibiotic stewardship;
(3) Governance and leadership;
(4) Quality management program; and
(5) Health information management services.
