The provisions of 25-8-202(1)(i) and 25-8-401(2), C.R.S. provide the specific statutory authority for adoption of these regulatory amendments. The Commission also adopted the following statement of basis and purpose.
BASIS AND PURPOSE
The revisions adopted in this rulemaking proceeding reflect and conform to concurrent revisions to the Cherry Creek Reservoir Control Regulation. New section 21.4 provides that the Commission shall provide the opportunity for formal public adjudicatory hearings to consider appeals of final decisions by the Cherry Creek Basin Water Quality Authority pursuant to section 72.4 , 5 CCR 1002-72.
