Section 6 CCR 1007-1-4.39 - Additional Disposal Requirements4.39.1 Compliance with Environmental and Health Protection Regulations. 4.39.1.1 Nothing in 4.33, 4.34, 4.35, 4.37, 4.38 or 4.39.2 relieves the licensee or registrant from complying with other applicable Federal, State and local regulations governing any other toxic or hazardous properties of materials that may be disposed of pursuant to 4.33, 4.34, 4.35, 4.37, 4.38, or 4.39.2.4.39.2 Disposal of Certain Byproduct Material 4.39.2.1 Licensed material as defined in paragraphs (3) and (4) of the definition of Byproduct material set forth in Part 1, Section 1.2 may be disposed of in accordance with Part 14 or equivalent regulations of NRC or an Agreement State, even though it is not defined as low-level radioactive waste. Therefore, any licensed material being disposed of at a facility, or transferred for ultimate disposal at a facility licensed under Part 14, or equivalent regulations of NRC or Agreement State, must meet the requirements of 4.38.4.39.2.2 A licensee may dispose of byproduct material, as defined in paragraphs (3) and (4) of the definition of Byproduct material set forth in Part 1, Section 1.2, at a disposal facility authorized to dispose of such material in accordance with any Federal or State solid or hazardous waste law, including the Solid Waste Disposal Act, as authorized under the Energy Policy Act of 2005.Colorado Register, Vol 37, No. 14.
