Section 3.403 - Consent to Release of Medical Information(1) Any request for an external review pursuant to 958 CMR 3.400 shall include the signature of the insured, or the insured's authorized representative authorizing the release and forwarding of medical information and records relevant to the subject matter of the external review, in a manner consistent with state and federal law, to any external review agency assigned to conduct external reviews pursuant to 958 CMR 3.407.(2) In connection with any request for an external review, the carrier shall assure that the insured, and where applicable the insured's authorized representative, has access to any medical information and records relating to the insured, in the possession of the carrier or under its control.Amended by Mass Register Issue 1494, eff. 4/28/2023.
