Section 38.04 - Eligible Property(1) An Eligible Property shall:(a) have one or more eligible Housing Units;(b) be in compliance with local zoning requirements or be exempt from such requirements; and(c) not be owned by the applicable AA.(2)Inspections of Eligible Properties. (a) Housing Units leased to a Service Provider shall be inspected and approved by DMH licensing, in accordance with 104 CMR 28.14: Licensing and Operational Standards for Community Services, and DMH guidance, before initial occupancy and annually thereafter.(b) Housing Units leased to a Client-tenant shall be inspected and approved before initial occupancy by the municipal board of health for compliance with the State Sanitary Code or by the AA consistent with DHCD guidance, except as otherwise provided in DHCD guidance.Amended by Mass Register Issue 1377, eff. 11/2/2018.
