A multiple dwelling is considered to be either a lodging facility or a residential facility for hire, rent, lease, or sale containing three or more dwelling units in a building. Facilities used for temporary accommodations are considered transient lodging facilities. See521 CMR 8.00: TRANSIENT LODGING FACILITIES. 9.1.1 A lodging facility is a building or a portion of a building, primarily used for the purpose of sleeping accommodations. Lodging facilities shall include but not be limited to shelters, hospices, group homes, and congregate living facilities. A dwelling unit in a lodging facility is defined as the sleeping space provided to a single individual; i.e., a bedroom.9.1.2 A residential facility is a building or buildings consisting of dwelling units each of which provides complete, independent living facilities for one or more persons, including permanent provisions for living, sleeping, eating, cooking and sanitation. When a dwelling unit houses more than three lodgers or boarders it is a lodging facility. Residential facilities shall include but not be limited to apartments, condominiums, assisted living and cooperatives.
