(1) The record in a hearing under this chapter shall consist of the charge, the complaint, answer, motions, rulings, orders, audio recording or stenographic transcription, stipulations, exhibits, documentary evidence, deposition and amendments to any of the foregoing.(2) Whenever a hearing concerns, in whole or in part, facts or issues which were or could have been litigated in a related representation proceeding, the Department or hearing officer may incorporate in the record such parts of the record of the representation proceeding as may be appropriate.(3) The record before the Board on review of a hearing officer decision shall be as set forth in 456 CMR 13.19(3).Adopted by Mass Register Issue 1322, eff. 9/23/2016.
